Alabama, the Fight for Families continues!

Since the passage of SB 176 three weeks ago, Fight for Alabama Families has been evaluating potential pathways to full and permanent protection of IVF in Alabama. We believe one potential pathway to full and permanent protection is a federal law. Therefore, we will be working to secure Alabama co-sponsors and to pass the Access to Family Building Act of 2024. 

What you need to know about Access to Family Building Act of 2024:

  1. It applies to the entire U.S. (not just Alabama): The Access to Family Building Act of 2024, S. 3612/ H.R. 7056, was introduced in the US Senate by Senator Tammy Duckworth (IL) and Senator Patty Murray (WA) and in the House by Representative Susan Wild (PA). It is a federal bill that, if passed, would become a law in the U.S. 
  2. It creates a statutory right to access IVF and other ART (Assisted Reproductive Technology) services and ensures they remain legal and available everywhere in the US. 
  3. Specifically, this bill provides protections to individuals who want to access services, such as IVF, and healthcare providers who provide ART services;
  4. The bill will also: 
    • Protect an individual's right to the use or disposition of their reproductive genetic materials, including gametes;
    • Allow the Department of Justice to pursue civil action against any state, government official, individual or entity that violates protections in the legislation;
    • Create a private right of action for individuals and healthcare providers in states that have limited access to ART.

Dear <Lawmaker>,

As your constituent, I am asking for your support to keep access to medical treatment such as IVF legal and available everywhere in the U.S. by co-sponsoring the Access to Family Building Act, HR. 7056/S. 3612. One in 7 women in the U.S., aged 15-49, have trouble getting pregnant or sustaining a pregnancy, and some of these women may need IVF to build their family. This issue is about families and protecting their ability to bring children into this world. We need the Alabama federal delegation to lead on this issue and help signal to the country that this is a bi-partisan issue that needs a bi-partisan solution.

Many states have introduced legislation that would restrict or prohibit access to IVF, a medical treatment that results in 2% of all births in the U.S.  I want to ensure that every American, regardless of what state they live in, has access to the medical care they need to build their family. 

The Access to Family Building Act of 2024 would establish a statutory right to access IVF and other ART services and ensure they remain legal and available everywhere in the U.S. by: 

(1) Establishing a statutory right for an individual to access, without prohibition or unreasonable interference, assisted reproductive technology services, such as IVF, and for a healthcare provider to provide ART services;
(2) Establishing an individual's right regarding the use or disposition of their reproductive genetic materials, including gametes;
(3) Allowing the Department of Justice to pursue civil action against any state, government official, individual or entity that violates protections in the legislation; and
(4) Creating a private right of action for individuals and healthcare providers in states that have limited access to ART.
